The Commercial Division of the High Court in Accra has reportedly thrown out a suit against Kantanka Automobile Company Limited and its Chief Executive Officer (CEO), Kwadwo Safo Jnr, over a social media pledge.
The company and its CEO were sued by a private citizen, Jude Osei, for supposedly failing to honour a pledge to reward social media users who were able to share a certain number of posts on the company's product, with a car.
According to a report by thelawplatform.online, the court, during proceedings on February 17, 2025, ruled that the plaintiff failed to prove that the social media handle used to make the promise of a car reward for a certain number of posts belonged to an agent of Kantanka Automobile Company Limited.
It added that the account used to make the pledge, as argued by the defendants, was fake and, therefore, the company cannot be held responsible for the promise it was used to make.
Background:
Kantanka Automobile and Kwadwo Safo Jnr were sued over a failed social media promise made by an account, @kantanka_daily.
In a writ issued on May 14, 2019, plaintiff Jude Osei said that he received a message from Kantanka Automobile's private account, instructing him to share a picture of a Kantanka Automobile car on Twitter. If he was able to get 30,000 retweets, he would be rewarded with a Kantanka Mensa car.
After almost a year, Jude Osei was able to gain 30,000 retweets. He subsequently sent a message to Kantanka for his reward, but around the time he asked for his car, Kantanka Automobile issued a disclaimer, stating that the general public should treat any tweet offering a Kantanka Mensa for 30,000 retweets as a hoax.
Jude Osei raised concerns about why the company remained silent and never issued a disclaimer for almost a year, only announcing it after he had gained over 30,000 retweets. Based on this, he headed to court.
Jude Osei's lawyer, Felix Nana Osei, argued that the account is not fake, as the handle was once used to tweet a message to Sarkodie, to which the rapper responded.
The tweet was also retweeted by Kwadwo Safo Jnr using the same handle, @kantanka_daily.
He also argued that even if the account was fake, the company should not have waited for over a year before issuing a disclaimer.
They are, however, demanding: a declaration that, at all material times, the defendants caused, allowed, and/or permitted the @kantanka_daily Twitter account to present itself as an agent of the first defendant; damages for breach of contract; and a declaration that @kantanka_daily entered into a valid contract with the plaintiff to the knowledge of the defendants, among others.
