Court strike out motion against President's nominee for Fanteakwa DCE

Koforidua, Oct. 18, GNA - A Koforidua High Court presided over by Mr Justice Tom Bentil, on Tuesday struck out a motion filed against the ruling of the court, in respect of the holding of elections to confirm the District Chief Executive (DCE) nominated for Fanteakwa.

The case was struck out on a submission made by the Attorney General's Department (AG), represented by Mr George Essampong, that the matter had political implications so the Regional Minster had intervened to have the matter amicably settled.

According to Mr Essampong, both counsel for the plaintiff, Daniel Obeng Asihene and the defence counsel had resolved to get the motion struck after the intervention of the Regional Minister. Mr Asihene who was at the court confirmed the submission by Mr Essampong.

By this ruling the Electoral Commission (EC) and the Fanteakwa District Assembly could now hold the election to endorse the President's nominee for Fanteakwa District as the DCE. A citizen of Begoro, Mr Asihene filed a writ at the High court restraining the EC and the Fanteakwa District Assembly from holding elections to confirm the President's nominee, the incumbent DCE, Mr Ebenezer Ofoe Caesar for financial impropriety.

The court struck out the writ for lack of merit because the defendants were not given two weeks notice of the suit at the court. The plaintiff, who was not satisfied with the ruling, filed another motion at the high court for the review of its earlier decision on the case.
