The decision by a Court of Appeal not to start the criminal trial of former COCOBOD boss, Stephen Opuni, from scratch, has been affirmed by the Supreme Court.

According to a news report by citinewsroom.com, the ruling for the case to be started from the very beginning again was made by Justice Kwasi Anokye Gyimah who was assigned to the case after Justice Hornyenugah retired.

This was because the new judge believed that the records had been tainted due to the allegations of unfairness against Justice Hornyenugah, the report said.

But that assertion was challenged by the Attorney General and Minister of Justice, Godfred Yeboah Dame, leading to an appeal at the Court of Appeal.

Justice Gyimah’s decision was therefore reversed by the Court of Appeal, asking that the case continue from where Justice Horneynugah left the case.

But lawyers for Stephen Opuni filed an appeal at the Supreme Court challenging the decision of the Court of Appeal.

In its ruling on the appeal on Wednesday, June 19, 2024, the apex court presided by Chief Justice Gertrude Esaaba Torkonoo, in a unanimous decision, however, dismissed the matter.

By this, the apex court has reaffirmed the Court of Appeal’s decision on the matter of whether or not to start the case from scratch.

The High Court hearing the case is expected to continue hearing the case.

Meanwhile, Seidu Agongo, the second accused, has opened his defence, with his fifth witness also testifying, the report added.
