A Ghanaian citizen, Bismark Aborbi-Ayitey, has sued the Electoral Commission over its decision to hold the Ayawaso West-Wuogon by–election on January 31, 2018.
The suit filed at the Supreme Court says the election as per Article 112 (5) of the 1992 Constitution, is supposed to be held 60 days after a seat is declared vacant.
The plaintiff avers that following the death of the New Patriotic Party (NPP) MP for Ayawaso West Wuogon, Parliament formally declared the seat vacant and informed the EC on November 26, 2018.
And so, the election is supposed to be organised on or before January 26, 2019 and not January 31, 2019.
A former Deputy Attorney General under the erstwhile NDC government, Dr. Dominic Ayine is representing the plaintiff.
