Kenbond: Group asks Supreme Court to expunge CHRAJ’s conclusion

The heavily contended report on the 2.25 billion dollars bond has landed the Commission of Human Rights and Administrative Justice (CHRAJ) in trouble as they have been sued by an advocacy group.

The group Dynamic Youth Movement of Ghana (DYMOG), in a writ filed at the Supreme Court Friday, January 26, 2018, claims that CHRAJ contravened the Constitution when it cleared the Finance Minister of any wrongdoing in its investigative report on a petition filed by Ashanti Regional Youth Organizer of the NDC, Yaw Brogya Gemfi.

CHRAJ in the report concluded: “On the basis of the evidence available to the Commission, it has come to the conclusion and therefore holds that the allegations by the complainant that the respondent has contravened Article 284 of the 1992 Constitution by putting himself in a conflict of interest situation in relation to the issuance of the 5-year, 7-year, 10-year and 15-year bonds, have not been substantiated.”

This conclusion according to DYMOG contravened Article 287 of the 1992 Constitution.

Article 287 of the Constitution empowers CHRAJ to investigate complaints of failure to assets and liabilities and conflicts of interest against a Public Officer.

DYMOG in its writ is claiming that “by interpreting Article 284 of the 1992 Constitution (as disclosed between paragraph 3 of page 127 and paragraph 3 of page 133 of the Report), the 2nd Defendant has contravened Article 130(1)(a) of the 1992 Constitution.”

The DYMOG is therefore asking the Supreme Court to expunge the paragraph clearing the Finance Minister of Conflict of Interest from the CHRAJ Report.

“A consequential order that the content of the report as specified in reliefs (a) and (b) above be expunged from the Report,” the writ indicated.
