Supreme Court assigns re-collation case to new High Court judge

The Supreme Court has ruled that the mandamus application concerning disputed parliamentary election results will be reassigned to a new judge at the High Court.

This decision comes after the Supreme Court found that the original High Court judge, Rev. Fr. Joseph Agyemang, had infringed upon the right to a fair hearing of the National Democratic Congress (NDC) parliamentary candidates when he granted the application in favour of candidates of the New Patriotic Party.

Consequently, the apex court, in a ruling on Friday, December 27, 2024, nullified the re-collation results for the constituencies of Tema Central, Ablekuma North, Techiman South, and Okaikwei Central from the 2024 parliamentary elections.

However, the results for the Ahafo Ano North and Nsawam Adoagyiri constituencies were upheld and remain valid.

This ruling challenges the re-collation process previously undertaken by the Electoral Commission (EC) and the subsequent seat declarations for the constituencies in question.

The Supreme Court made it clear that although the re-collation results are quashed, the mandamus application is still active and must be reheard in the High Court on Tuesday, December 31, under the oversight of a new judge.

Presided over by Justice Gabriel Pwamang, the Supreme Court panel also included Justice Prof. Henrietta Mensa-Bonsu, Justice Ernest Gaewu, Justice Henry Anthony Kwofie, and Justice Adjei Frimpong.
