'This case is not ending here; we will go to the Supreme Court' - Bernard Mornah

The Flagbearer of the People's National Convention (PNC), Bernard Mornah, has vowed to take the legal battle concerning his disqualification to the Supreme Court.

According to him, "the judge did not look at the case that was brought to the court, it just went round. And I have instructed my lawyers that this case is not ending here. We will go to the Supreme Court so that this matter will be determined.”

This was contained in a post shared by CITIFM 97.3 on X on October 21, 2024.

Bernard Mornah’s statement was prompted by the dismissal of his lawsuit challenging his disqualification by the Electoral Commission of Ghana.

He explained that his lawyers will immediately apply for the judgment and critically study it for their next line of action.

“That is why my lawyer said that they will quickly apply for the judgment. Based on the study, of course, we just listened to it, we will study it critically. But I have already instructed them that we have to go to the Supreme Court because I do not think that multi-party democracy should be jettisoned just from the corners of the EC without our involvement.

“In past elections, the EC would sit down with parliamentary and presidential candidates and point out what they think are the errors. In this instance, we are not even part of it,” he added.

The PNC further said that the Electoral Commission should have invited the IT committee of the PNC to have a discussion to settle the alleged technical inadequacies identified.

“The EC sat down somewhere and claimed they have a technical and IT committee. Doesn’t the PNC have an IT committee? Don’t we have an IT person? If the EC was determining IT issues, our IT person should have been there so that they would be able to iron out the IT inadequacies they are talking about. None of these things were brought to our attention and the judge will come and grant the wishes of the EC,” he stated.

Bernard Mornah believes that “justice has been grossly traversed.”

Background

The Electoral Commission of Ghana, on September 20, 2024, disqualified Bernard Mornah and nine other presidential candidates from the race due to errors found in their nomination forms.

However, Bernard Mornah, the Flagbearer of the People’s National Convention (PNC), filed a lawsuit challenging his disqualification, but the case was dismissed by a High Court in Accra, stating that the disqualification was lawful.
