‘Too old’ case: Amidu storms Supreme Court

Mr. Martin Alamisi Burns Kaiser Amidu has arrived at the Supreme Court in a case challenging his age as the country’s first ever Special Prosecutor.

The Bolga East Member of Parliament, Dominic Ayine dragged the SP to the Supreme court pleading for the annulment of his appointment on grounds of old age.

But in his correspondent affidavit to the apex court, Mr. Martin Amidu contends the plaintiff’s argument is flawed describing it as politically motivated. According to him, he’s duly qualified for the SP position.

He’s insisted the suit was engineered by functionaries of erstwhile Mahama administration who are frightened by his action to clamp down on corruption in government.

He’d further argued that Dr Ayine does not “appreciate the fact that Parliament has residual power under the 1992 Constitution to enact sui generis provisions in an Act of Parliament such as Section 13 of Act 959 to deal with matters such as the intractable canker of corruption and corruption-related offences expressly proscribed by the Constitution and laws of Ghana by engaging such legal talents on such terms and conditions as would effectively achieve the objective of the Constitutional proscriptions.”

Meanwhile the Attorney General, Gloria Akuffo has argued that the position of Special Prosecutor is a public office (organ) like the Statute Law Revision Commissioner, not caught by the retiring age prescriptions in Article 199.

The applicant in the case, Dr Dominic Ayine is also a former Deputy Attorney General in the previous NDC government.

Correspondent Daakyehene Ofosu Agyemang reports that Lawyer Tony Lithur, Deputy Attorney General Godfred Yeboah Dame all seated for the case.
