The Supreme Court's decision to overturn Speaker Alban Bagbin's declaration of four seats in Parliament vacant has generated extensive reactions on X as of Wednesday, 13 November 2024.
In a 5-2 majority ruling, the Supreme Court determined that the Speaker's declaration of the four seats vacant was unconstitutional.
This decision followed a lawsuit filed by Alexander Kwamina Afenyo-Markin, leader of the New Patriotic Party caucus in Parliament, challenging the constitutionality of the Speaker's ruling.
The five justices who ruled in favour of Afenyo-Markin's suit were Chief Justice Gertrude Torkornoo, Justice Mariam Owusu, Justice Samuel Kwame Adibu-Asiedu, Justice Ernest Yao Gaewu, and Justice Yaw Darko Asare.
On the other hand, two justices opposed the application on jurisdictional grounds, siding with Bagbin: Justice Avril Lovelace Johnson and Justice Issifu Omoro Tanko Amadu.
The five justices in the majority have been nicknamed 'Unanimous FC' by Ghanaian netizens.
Critics remarked that the majority decision and voting pattern were unsurprising, noting previous instances where the same justices delivered similar rulings.

We already knew the outcome. Today I have realized u don't need legal knowledge to be a judge in Ghana especially to the Supreme Court. U need political affiliation. @JDMahama plz constitutional review should get judges elected and not appointed high & supreme Court pic.twitter.com/uKbMvvLvuv
You don't needs to be a prophet to tell the minds of the Unanimous FC 🤷♂️

A 5️⃣-2️⃣ decision is not a unanimous decision. We shouldn't allow politics to blind us into misinforming or miseducating our listeners and viewers, please!!!! Stop that UNANIMOUS FC mantra! You have contributed to the bad perception about our judiciary!

Unanimous FC at the supreme Court please tell us what should be the punishment or consequences to a MP, if he or she decides to switch sides in parliament. So tomorrow when MPs decide to switch to a different political party what happens to them. MPs can do whatever they like🤔 pic.twitter.com/tGdBQ67MRj
