Wen di matter come up for hearing on Wednesday, Aloy Ejimakor, wey dey represent Kanu invoke section 17 of di Federal High Court Act, and section 174 of di 1999 constitution.

According to Ejimakor, di sections provide say parties fit explore alternative options for both civil and criminal matters.

However, counsel to di Nigeria goment, Adegboyega Awomolo, tell di court say Ejimakor never discuss wit am about an out of court settlement.

"E no dey my hand to initiate any tok for out of court. If Di defence want, may dem approach di Attorney General of di Federation, na im get power to initiate processes like dat," Awomolo tok.

Justice Binta Nyako agree wit Awomolo and tok say na di defence e dey im hand to approach di AGF, and dat she no get any problem wit am.

"If di AGF wan begin out of court proceedings, make im file am before me, I go hear am," Nyako tok.

Meanwhile, di court bin dismiss two applications wey Ejimakor bin move on Wednesday.

One of di applications na say di court no get jurisdiction to entertain di matter sake of say e go against di constitution and against di Administration of Criminal Justice Act (ACJA).

But Justice Nyako strike di applications out. She tok say she bin don rule on di application before and na abuse of court process for di defence to move am again.

"If you no dey happy wit my earlier rulings, you get option to appeal am," Justice Nyako tok.

She adjourn di matter to September 23, 24 and 25 for hearing.
