Kumasi, Jan. 23, GNA - Mr Osei Assibey-Mensah of Ashanti New Town in Kumasi, has petitioned the Chief Justice, Mr Justice George Kingsley Acquah over the long delay in hearing a suit he filed against Leo Shield Exploration N.I. of Accra and Resolute Amansie Limited at a Kumasi High Court since April, 2002.
He has prayed the Chief Justice to transfer the case from the Kumasi High Court Three where Mr Justice I.K. Abrahams presides to another court.
In his petition, Mr Assibey-Mensah, who is the Managing Director of Oda River Gold Mining Company Limited, said since he filed the suit in April 2002, the case had been mentioned only on three occasions, March 14, March 26, and June 14, 2004.
He alleged that on the third adjourned date, June 14, 2004, the presiding judge fixed it for November 22, 2004, but expressed regret that on the said date, the docket was not even brought to the court. Since the date of filing the suit to date the petitioner said, the case had been at the Kumasi High Court Three for two years nine months and said with his age at 82, Justice Abrahams was being unfair to him by delaying the case thereby denying him justice. Mr Assibey-Mensah said since the judge was being unfair to him, the Chief Justice should transfer the case to another court, adding that since he would be able to complete his evidence in two days, he would like to be given the opportunity to open his case as early as possible without any further delay.
