Mac Tontoh to pay ?3 million

AN Accra High Court presided over by Mrs Justice H. Inkumsah-Abban has slapped ?3 million costs against Mac Tontoh and Aboagye Asiama after the two had withdrawn a case they initiated against the holding of the Musicians Union congress at Ho.

Mac Tontoh and Asiama had on February 5, 2003, initiated an action to restrain the holding of the national delegates congress of MUSIGA, which took place in Ho on February 7, 2003.

Messrs Tontoh and Asiama then caused to be announced on Joy FM on February 5, that the High Court had granted an order of interim injunction to restrain the holding of the Ho congress.

In respose, the President of MUSIGA, Alhaji Sidiku Buari, also initiated an action on behalf of the union against Tontoh and Asiama on February 6, 2003 to obtain a valid and competent order of interim injunction to restrain the two and their agents from interfering in any way with the congress on February 7.

On February 17, 2003, when Tontoh and Asiama?s motion came up for hearing at the High Court, not only did they and their lawyer not turn up but also they wrote to the court to discontinue their purported action.

The court, in the circumstance, awarded costs of ?3 million against the two applicants.
