Case closed, Tony Lithur has agreed there was over voting in the Presidential election held on December 7th and 8th 2012. Tony Lithur has talked himself into a hard rock and deep blue sea by asking a question that even a first year law school student would not dare ask and got punked really bad. There is a cardinal rule in law that is law 101 that says a lawyer should not ask a question he or she does not know what the answer is going to be and Lithur has broken that cardinal principle many times in his cross examination with the fatal one coming yesterday that might have hurt the Respondents case immeasurably.
''Lithur picks another pink sheet which has a figure at the portion of CI. He says the figure is ineligible. He asks Bawumia how he was able to arrive at the conclusion that there was over voting in the polling station. Bawumia takes a look at the pink sheet in question and says the number at the CI portion is 733 but the total votes cast in the polling station was 763. That was clear over voting, he adds.
Lithur returns and says the figure there is unclear. It could be 739. Bawumia responds and says even if it is 739 as the counsel for the respondent is suggesting there is still over voting because the total number of votes cast in that polling station exceeded the total number of registered voters. "
Seriously, where did Lithur obtain his law degree? I am just straddling the fence and watching proceedings and cannot believe Tony Lithur's sophomoric mistakes and the histrionic pranks he pulling at the court.
This is the biggest mistake he has made so far in his cross examination. Did Lithur consult Tsatsu before asking the above question and the worst part confirming Dr Bawumiah's assertion that there were over voting in the December 7th and 8th election.
Lithur should not have asked that question not knowing what the answer was going to be when Dr Bawumiah said this;
"CI portion is 733 but the total votes cast in the polling station was 763"
The C1 portion is the total number of voters so when Dr Bawumiah said the total number of votes cast was 763, instead of Tony Lithur coming up with a lower number than 733, read what he said;
"Lithur returns and says the figure there is unclear. It could be 739."
Really, geniues Lithur? Are you not aware that any number above the 733 registered voters is an over voting so even if there was 733 registered voters and you have 734 people voting there is over voting? You instead agreed that the number could have been 739 which is still over voting? After Lithur's "boubou" admitting a number of 739, Dr Bawumia responds that if it is 739 as the counsel for the respondent is suggesting there is still over voting because the total number of votes cast in that polling station exceeded the total number of registered voters. "
Lithur should have stopped before asking that dumb question but I think he is enjoying the limelight being shown on him and cannot let it go. Now we are getting to the real numbrers after using pink sheets that the Petitioners have already deleted from their evidence and that is why he rejected Dr Bawumiah from looking at his notes to prove that the Respondents might have inserted these pink sheets after they have been deleted as Petitioners Lawyer Addison intimated.
"Lithur presents to the court another pink sheet exhibits. Counsel for the petitioners Philip Addison raises an objection to the tendering of the pink sheet, saying there are cancellations and deletions on the pinks sheets with a high possibility of the document being tampered with by the respondents."
Good job Mr Addison, that has been my suspicion all along. A thief can do anything and it is more than likely the Respondents with Asiedu Nketiah at the forefront has engaged in chicanery on the pink sheets.
