Appiah Kubi praises the Supreme Court's decision regarding result recall.

Andy Appiah Kubi, the Asante Akim North Member of Parliament, has praised the Supreme Court's decision in relation to the High Court's order on the recall of results in certain seats.

Before rendering a decision, the High Court ought to have given the National Democratic Congress (NDC) a chance to argue its position, according to private attorney Appiah Kubi.

"The Supreme Court performed admirably.In an interview with TV3 on Saturday, December 28, he stated that the High Court should have given the NDC the opportunity to present their case.

"I commend the Supreme Court for the direction given now," he added. Audi alteram partem, or "hear the other side," is a universal principle that even God used in the Garden of Eden.

The Accra High Court has been directed by the Supreme Court to reexamine the NDC's mandamus appeal with regard to four constituencies—Okaikwei Central, Ablekuma North, Tema Central, and Techiman South—whose results are under dispute.

In a unanimous 5-0 verdict on Friday, December 27, the Apex Court decided that as the NDC was an interested party that would be impacted by the decision, the sitting judge in the case ought to have heard their legal counsel regarding their application to join the NPP's mandamus request.

A High Court decision that ordered the Electoral Commission (EC) to recollect the results of parliamentary elections in nine contested constituencies was being contested by the NDC.

Citing irregularities in the results compilation and the subsequent announcement of victors, parliamentary candidates from the New Patriotic Party (NPP) and the National Democratic Congress (NDC) had filed a writ to force the EC to hold new elections in these constituencies.

Despite protests from NDC legal representatives, led by Godwin Edudzi Tameklo, Presiding Judge Joseph Adu Owusu Agyeman directed the EC to re-collect the results in the Ablekuma North constituency on Friday, December 20. Although the attorneys contended that the outcomes of these constituencies had already been announced, the court decided that the irregularities in the procedure called for a reconsideration.
