High Court dismisses case against Kantanka Automobile over Twitter promise of car for 30,000 retweets

The Commercial Division of the High Court has dismissed a case filed by one Jude Osei against Kantanka Automobile Company Limited and its Chief Executive Officer, Kwadwo Safo Jnr,” according to thelawplatform.online news report.

According to the report, the lawsuit sought to enforce the delivery of a Kantanka Mensah vehicle, which the plaintiff claimed was promised to him via a social media post.

The legal action, filed on behalf of Mr. Osei by his lawyer, Felix Nana Osei, Esq., was based on an alleged commitment made by a Twitter (now X) account under the handle @kantanka_daily.

The post in question reportedly promised a Kantanka Mensah car to Osei if he could generate 30,000 retweets.

However, after reviewing the arguments from both parties, the Court ruled that the plaintiff failed to establish that the @kantanka_daily account was an official representative of Kantanka Automobile.

The defendants, represented by their lawyer, Nana Kofi Safo Kantanka, Esq., argued that the said account was, in fact, a parody account and not an authorized entity of the company.

The Court, in applying principles of contract and agency law, determined that no binding contract had been formed between the parties. Consequently, the case was dismissed.
