Ayikoi Otoo, a former attorney general and minister of justice, has voiced worries about the current election dispute, namely about the way the Supreme Court and the election Commission (EC) are handling the recall process.
Ayikoi Otoo stressed that, in his opinion, neither party has actually prevailed as a result of the court's ruling while speaking on JoyNews' Newsfile show on Saturday, December 28. He said that the process's impartiality had been jeopardized by the exclusion of important players.
"I do remember the time I argued for Dr. [name] when he was disqualified; I used this as one of my justifications, and it worked out well. I thought, "Wow, what is happening to this judge?" as soon as I saw this. He claimed that the exclusion of interested parties from the court proceedings was against natural justice principles. Otoo clarified, "We all know that the MPP lawyers who appeared in court are interested parties in the matter, so I even have trouble with them." He added that parties must be involved in the procedures when they have a stake in the outcome.
Otoo contended that the court had a duty to hear people who opposed the application, citing Rule 6:1 of the 55th Rule, but the judge rejected it. Ignoring this, he cautioned, might render the decision void. "You will encounter difficulties if you violate it," he stated. The Supreme Court refrained from rendering a decision on the merits. They have said, "We are going to revoke the decision you made because the people were not given a hearing," Otoo said. "In actuality, no party has won anything. You're going to have to start anew.
