The Electoral Commission's (EC) pronouncements for Okaikwei Central, Ablekuma North, Tema Central, and Techiman South were overturned by the Supreme Court, which also revoked the re-collated parliamentary election results for these constituencies. The decision highlights the judiciary's vital role in resolving electoral anomalies and maintaining constitutional procedures, and it was made amid heated legal and political debates surrounding the recollation process. The court maintained the re-collated results for Nsawam Adoagyiri and Ahafo Ano South West, confirming the validity of the process in those areas, even though it annulled the results in these four constituencies.
The ruling comes after the National Democratic Congress (NDC) filed a lawsuit challenging a December 20 High Court order for the EC to recollect results in nine contested constituencies. In seven constituencies—all of which were initially proclaimed victories for New Patriotic Party (NPP) candidates—the EC followed the directive. But there are still problems with the Dome/Kwabenya and Ablekuma North outcomes. The NDC has continuously denounced the recollection procedure as illegal, claiming that the High Court has overreached itself and compromised the integrity of the election.
"We have exercised our discretionary power to quash by certiorari, taking into account the unique circumstances of each case, since the orders brought for quashing are separate and distinct," said presiding Justice Gabriel Pwamang, who delivered the verdict in Accra. The EC's orders for re-collation in Okaikwei Central, Ablekuma North, Tema Central, and Techiman South are thus hereby revoked. Significant political ramifications are anticipated from this decision, and stakeholders and constituents will be keenly monitoring the course of events in the impacted areas.
