The National Democratic Congress (NDC) members Ebi Bright, Baba Sadiq, Christopher Beyere, and Ewurabena Aubynn submitted a preliminary legal objection, which the High Court rejected. The New Patriotic Party's (NPP) request for a Mandamus order prompted this objection. Okaikwei Central, Ablekuma North, Tema Central, and Techiman South are the four contested constituencies in which the NPP is attempting to force the Electoral Commission (EC) to recollect and announce the results.
Justice Forson Baah Agyapong rejected the objection, which claimed that the court lacked jurisdiction. The judge made it clear that this is an administrative case pertaining to the EC's responsibilities rather than an electoral petition. This decision permits the NPP's substantive case to move forward. Examining claims of anomalies and inconsistencies in the preliminary results compilation from the general elections in 2024 will now take front stage. According to the NPP's legal staff, procedural flaws tainted the results in these constituencies, requiring a recollation to guarantee accuracy and fairness. However, the NDC, which is represented by its candidates in the impacted constituencies, maintains that the EC followed the law when conducting the procedure.

Because the outcomes from these seats could have a substantial impact on parliamentary representation and the dynamics of legislative power, this ruling has heightened the political climate. According to analysts, the case demonstrates the escalating disputes about electoral integrity between Ghana's two main political parties. The legal proceedings that are taking place are being closely watched by observers, as they may establish a precedent for future electoral disputes in the nation. The issue also calls into question the Electoral Commission's responsibility and function in handling these kinds of disputes.
The EC's handling of the contentious findings and the validity of the NPP's claims will be examined in further detail in the upcoming round of the legal dispute. Ghana's legislative environment might change and the announced results could be changed if a Mandamus order is approved.
