A major blow has been dealt to the National Democratic Congress's (NDC) judicial challenge regarding the outcomes of parliamentary elections in six constituencies. In opposition to the NDC's attempt to reverse a High Court decision that mandated a recount of the election results, the Supreme Court rejected an objection.
The lawyer for the New Patriotic Party (NPP) parliamentary candidates in the impacted constituencies, Gary Nimako Marfo, contended on December 27, 2024, that the NDC's appeal ought to be denied because of a procedural error. He asserted that the NDC had not included the original High Court decision with its request, which is required by court regulations. This omission led Marfo to request that the Supreme Court reject the application.
Under the leadership of Justice Gabriel Pwamang, a five-member panel of Supreme Court judges dismissed the objection and decided in favor of the NDC. The panel observed that in order to resolve the procedural issue, the NDC had later provided the necessary ruling in a supplemental affidavit. The application was thus granted by the Court, and the NDC's argument could now be taken into consideration.
