When the Supreme Court ruled to invalidate the recounting of parliamentary election results in four constituencies—Okaikwei Central, Ablekuma North, Tema Central, and Techiman South—the National Democratic Congress (NDC) expressed great joy.
Justice Gabriel Pwamang, the presiding judge, stated in his ruling in Accra on Friday, December 27, that "We have decided to exercise our discretionary power to quash by certiorari having required to the peculiar circumstances of each ruling, since the orders which have been brought to be quashed are separate and distinct."
“Therefore, we hereby annul the mandates issued by the EC for the compilation of results in Okawkwei Central, Ablekuma North, Tema Central, and Techiman South constituencies.”
In contrast, the Supreme Court maintained the re-collated results in two additional constituencies—Ahafo Ano North and Nsawam Adoagyiri—keeping those results unaffected by its decision.
A member of the NDC's legal team, Marietta Brew Appiah-Oppong, spoke shortly after the decision and said she was happy with the result.
Marietta Brew Appiah-Oppong declared in her interview with Fred Duhoe of Channel One TV that the decision was a win for the rule of law and that it was important for preserving the integrity of elections and guaranteeing that justice is done in cases that were controversial.
It merely means that we must submit the affidavit opposing the mandamus application for the four constituencies by Monday. We are largely comfortable with the Court's directive that the hearing be held on Tuesday.
