Ghana Web reported on Monday, October 28, 2024, that Speaker of the House of Representatives Alban Bagbin has dismissed the service of a Supreme Court writ regarding his decision to declare four parliamentary seats vacant.
Ebenezer Ahumah Djietror, the Deputy Clerk of Parliament, wrote that the Speaker had directed that the petition be sent back to the Supreme Court.
The letter notes that the attempted service of the writ on Tuesday, October 15, 2024, breaches Article 117 of Ghana’s 1992 Constitution.
"I am directed by Rt. Hon. Alban Sumana Kingsford Bagbin, Speaker of Parliament, to return the attached processes which were left at the Legal Services Office of the Parliamentary Service, by three (3) bailiffs of the Court on Wednesday, 16 October 2024. Attempts were made to serve the same processes on Tuesday, 15 October 2024,” the letter states.
The Speaker pointed to Article 117 and a recent circular from Justice Cyra Pamela CA. Korangteng, which stresses immunity from service for certain parliamentary positions.
The Judicial Secretary instructed the judiciary to closely follow these constitutional provisions for legislative staff in a July directive.
"Therefore, the Rt. Hon. Speaker has directed the return of the attached processes for your necessary action," reads the letter's conclusion from Speaker Bagbin's office.
