New Patriotic Party (NPP) Constitutional and Legal Committee Chairman Frank Davies explained that the party was not prepared for the recent Supreme Court decision that ruled the Speaker's actions were unlawful.
Chief Justice Gertrude Torkornoo led the Supreme Court in ruling 5-2 that the Speaker's announcement was unconstitutional. The decision was made public on Tuesday.
During an interview on Joy News’ PM Express, Mr. Davies noted that the Speaker had been given ample opportunity to defend the legality of the declaration in court but did not present a case.
"The Speaker had the opportunity to present the court with a statement of the case. They decided against it. "Should the judges have waited forever for the Speaker?" "Did the court act fairly under the circumstances?" he inquired.
Mr. Davies explained that the ruling was based solely on the case’s merits and not on assumptions or expectations.
He stressed the importance of the split ruling, noting that two judges dissented, demonstrating the complexity of the matter. "It's incorrect to say this was anticipated," he said.
Although the Speaker did not bring a case, two justices dissented and five of the justices ruled against the statement. How do they feel? referring to the judiciary's independence and diversity of viewpoints, he continued.
The complex legal arguments that the court took into consideration are reflected in the divided ruling. Even without the Speaker's justification, Mr. Davies pointed out that the judges' divergent views further demonstrated that the outcome was unexpected.
He urged the public to respect the judicial process and recognize the Supreme Court’s careful deliberation.
In his conclusion, Mr. Davies said, "This decision demonstrates judicial independence and reaffirms our courts' commitment to upholding the constitution, even in complex cases."
