It is borne of a misplaced arrogance by an individual who cannot accept the very legal structures that he a spouses and for which he was once a national servant in his capacity as attorney general. It is a pity that Nana and his fellow NPP leaders commit blunder after blunder. Personally I doubt if he is really in control and driving this process. I have a feeling others like Jake Obetsebi Lamptey are driving this train which is rolling uncontrollably towards disaster.

Own ground rules for anything he does.
He and his team want to engage in trial by "ambush",which is raelly a technique of the past. 'Voire dire' or disclosure is now the accepted norm, and as we all know, his stance is yet another convenient way to shift blame on others. Check this out:
We, the petitioners, believe there were under-handed dealings in 4709 polling stations, but I don`t think it is necessary for the respondents to call witnesses from these polling stations to refute them.
We want the respondents to provide answer(s)to claims they are not familiar with, but we want them to prvide answers anyway.
As Tarzan has pointed out,all these are part of the "self-promotional gimmick" intended to deceive their supporters.

The accuser knows he has to prove period. Someone accused K4's brother of being a shareholder in metro mass transport. He could not produce the registration from the Registrar General becuase he could not gain access there. The judge did not order Registrar General to produce the information. End of case. He was fined GHC6 billion those days and had to run for life.

As I was reading through this article, “STRATEGY” kept popping up in my thoughts. So I asked: Could these objections be the strategy of one who knows he lost fairly and yet intends to make good the threat “If they make the wrong move by arresting any of our officers, they will know no peace and this country will suffer for that. We are not scared to be arrested but if they try to arrest any of us we will make this country ungovernable.”.?????
The above statement was made (by Kwadwo Owusu Afriyie, General Secretary, New Patriotic Party) on the 12th of December 2012, some 3 days after the declaration of the results. He justified this assertion by telling the world that the NPP, in the wake of disturbances carried out by their supporters, had gathered intelligence that government was going to arrest some of their leaders. Before this, we heard on various campaign platforms of how some leaders of the NPP were not ready to accept any results that did not declare them as winners.
They have taken the case to court, and till now, as you rightly put it, they are the only ones that are raising objections and causing delays to the process. So is this a strategy? Is this a strategy to sow doubts (in the minds of citizens and the international community) on the validity of the results, knowing that the allegations cannot be proved in court? When one adds these objections to the boycotts, it is fair to start assuming that the current strategy of the leaders of the NPP is to “make the nation ungovernable.” They said it, and they are pursuing it.
Fortunately for Ghana, the law allows for a president to be sworn in and government to continue functioning even in the course of a legal challenge of the validity of an election’s results. Fortunately for us there are parliamentarians in the majority who will move this nation forward even in the “unfortunate and possibly reckless absence” of their minority colleagues.
Your article is a nice one. I enjoyed reading it. As for Mahama’s 4,800 witnesses, do not worry. I doubt if they will end up in court. But it all depends on the petitioners. If they come out with some strange narrations of what happened in the 4,709 polling stations where they allege the irregularities then of course, the court may decide to bring in as many of Mahama’s 4,800 witnesses to give their version.

The interesting thing about reading such in-depth analysis is that, it is bereft of the woolly-brained comments from howlers who find such articles above their comprehension.

Anyway, you should not behave like an ostrich that plays ignorance when the reality on the ground is in contrast to its beliefs. Do you not know what these NDC guys and Afari-Gyan are capable of as crooks as they are? Giving them those detail information before hand will let them carry out their usual nefarious activities in attempt to obliterate the truth. The requested information will be provided to them during the trial which possibility you have asserted is feasible.
As the EC are being given copies of proofs covering the disputed polling stations, it will be required of them to supply the copies of pink and blue papers covering same polling stations.
The legal team of Nana Addo should make a simultaneous request to the EC via the Supreme Court to supply the team with all the pink/blue sheets covering all the 26,000 polling stations. Then both teams (EC and Nana Addo) will exchange the copies as requested by each at the same time. This will make it difficult for each of them to alter any evidence once exchanged.
The EC should not be allowed to know the contested polling stations beforehand. I don't trust the EC and the NDC. They are crooks who are capable of executing any silly acts that they deem will enhance their chances of acquiring whatever they dream of.

Any way, as you will agree with me the subject matter of the article was not about tempering with evidence and therefore your concerns about EC or any other party tempering with pink or blue sheets is irrelevant to the article.
You are right to suggest that the petitioners could also request the EC for original copies of the pink and read sheets covering the 26,000 polling stations. However, will that be necessary since the petitioners are only disputing results from less than 5,000 polling stations? Would that not be another time wasting, which is the subject matter of this article?
In my view, the best way to fasten this petition will be for the legal teams of the petitioners, the first, second and third respondents to meet and agreed on exchange of information/documents outside the court and only go to court for an order if any parties is reluctant to release information/documents requested.

oh Mr Kofi Ata,what shall i do with you?you have really reminded me of my days at uni of science and technology.you have really demonstrated how level minded you are.if only the npp supporters know about law, then they would think twice.i do agree with every single word or sentence from you.its sad and shame that the average Ghanaian, even including people, students and to say educated elites who has no law background can't understand that what you have written here is what hapens with court cases.i wish most people will read to understand as a lot of people talk rubbish here without sidelining the petition and the comstitution/law to know what happens.how is Npp going to proof beyond reasonable doubt?how come these npp lawyers couldnt foresee that the composition, the joinder of the NDc etc will not hold?NDC and Mahama stand in a fiduciary relationship in legal terms,in other words are inseperable.how could they not foresee that, the sc will allow the joinder.how are they going to proof that NDC or any othe party had this figure or that to favour NDC?do they not know that the courts can or will allow them to provide their so called strong evidence even before court proceedings?even if the court does not,are they aware when a question is asked, the ec can ask for time to go and look into the matter and come back later to ask?i can go on and on.all i say is well done.i have noticed that most people here who wrote articles here sidelining the petition and the constitution means the npp willloose.it takes only those who know law to realise this.Kofi stay blessed.
