It is interesting how the lead counsel of the petitioners fumbled about how many polling stations have been subtracted, and what pink sheets can now be considered valid to back their case, on Wednesday. Until now, we are yet to see evidence of how Mahama colluded with the NDC to cheat his way to the presidency; why did the petitioners not bring forward witnesses to make their case for vote paddings in favor of Mahama, overt-voting, or swapping, and who committed the fraud. If the EC clerical errors are the reason for which the election should be overturned , representing the cancellation of over 4 million votes, why should the errors of the petitioners be glossed over and their recategorization of evidence be fair game. I hope the courts knows what it's doing. You are perfectly right that the court has helped the petitioners to make some sense,albeit a weak one. I cringed when Bawumia was asked by Tsikata to show were the fraud occurred and one of the female Judges intervened, saying that the question was implicitly answered. Let's hope that the court helped the petitioners to only save face....

Just look at the difficulty Addison and his team have had in reaching their mythical figure of 11,842 "unique" pink sheets,they claim to have submitted to the court.
Apart from the the quantum of pink sheets, have the petitioners not been forced to eat a humble pie about the very issue they have accused the EC and its army of temporary officials about -sloppy labelling,faulty arithmetic and logic, outright lies, as well as underhanded dealings with the court and the Ghanaian public in general? As a result of the live broadcasts,the whole world has also witnessed the open and transparent nature of the the hearings. Would Owusu Afriyie and others not have gotten away with the mischief they deliberately sought to engage in if the proceedings were conducted behind closed?
I am of the view these sore losers would have confused the issues so much so that a fair resolution would have been imposible. Based on the directions given by the court,the petitioners have been forced to reveal to the world, what they, as true democrats, are prepared to do in order have their man become President of this great nation. I believe people can now begin to closely scrutinize the much-talked about democratic credentials of those individuals who,on the one hand, want THEIR votes to count,but are seeking to annul the votes of others on dubious grounds.
It is not for nothing that they abandoned their earlier bogus claims they sold their supporters on,and when they had to, were unable to that the 2012 elections were peaceful,fair and transparent!

Had the petitioners stuck to the initial allegations including fraud and collusion between the EC and the President, the burden of proof would have been far greater and the case would have fallen for lack of evidence long ago.
It is much easier to demonstrate irregularity than fraud or collusion.
Nonetheless, even with the helping hand they got, the petitioners have failed to provide reliable primary evidence with confusion over the number of pink sheets submitted.

The duty of a Court is to help define and simplify the issues to be tried before it. This is usually done at a pre trial conference. In this case, the Court gave the parties time to meet and iron out the issues, but they were failed. It was therefore incumbent upon the Court to define the issues based on the pleadings before it and the elements the Constitution and the Statutes require in presidential petitions. This is similar to Approved Jury Instructions in the US Courts. Delineating issues by a Court does not create advantage for anybody because the burden of proof still rest with the Petitioner. Bokor, fails to understand this and he is therefore an idiot. Tribe has nothing to do with this.

He is not questioning the judges right to streamline the issues, He is saying that in this case, they have helped the petitioners as the original complaints included fraud and collusion between the President and the EC. Had these issues been included in the petition, the case would have been dismissed by now because the petitioners have admitted there was no collusion, and no fraud. They have only pointed to irregularities.
However, the inconsistency, unreliability and selectivity of their evidence will be the undoing of this case.

All what they did was to identify the issues of contention as to whether there were infractions etc and if so did it affect the results.
You are now blaming the petitioners for not requesting for electoral reforms. How do we reform a system which you claim is working perfectly. Talking about electoral reforms means you now realize that the system has some faults. This in itself is a major win for the petitioners. The fact still remains that the primary evidence of the pink sheets is fatally flawed because of the uncertainty over how many were presented, the discrepancies between the various lots and the unreliability of the analysis of the sheets. The selectivity of the evidence is a further issue.
