You are aware that even among the nine Justices, five had different opinions on the same subject and they also provided reasons to justify why they rejected the claims. The author is only contributing to the debate. Would you have tagged him as NPP if he had argued in favour of the four Justices and against the five?

The only thing obvious from this article is its incisive deconstruction of the arguments of the learned justices in question to show how legally weak and fallacious they are.
I blame the NDC and Mahama's lawyers for doing a very poor job arguing these legal ramifications of the case though. As for the EC lawyer, he was no show! It beats my imagination why he couldn't present the signed originals of the Pink Sheets and prints from the barometric machines to disprove the claims of the petitioners, if INDEED, Afari Gyan was not lying about the signatures and everyone voting by barometric verification, with the exception of a few. Failure to do that weighted heavily in Justice Baffoe Bonnie's decision to award that relief, even though his reasoning too was faulty constitutionally. There was nothing in the Const about NBVNV and so that requirement conflicts with the basic right to vote. So if the people were verified by some other means, that should have been accepted as SUFFICIENT VERIFICATION to vote and thus making their votes valid.
Turning back to the context of this article, precedents from such earlier judgements were that votes should ONLY BE ANNULLED if the irregularity affects the ACTUAL votes cast, changing them in some way/s that caused disadvantage or loss to the petitioner! In this petition, that wasn't the case. I was therefore appalled to read Justice Owusu in particular engaging in a most fallacious summation which, in effect, has it that failure to sign, a priori, had effect on the votes cast and thus the votes must be annulled, since if they were annulled, it'd have effect on the votes cast as requested by the petitioners! Circumlocation? Elementary logic was thrown out through the windows of the SC! Instead, they relished themselves in Cartesian, mechanistic logic which does not allow for the nuances and ways in which consts normally change over time through judicial interpretation in recognition of changing circumstances, values, attitudes and better understanding of socio-political processes and relationships. They should go back an re-read K.C. Wheare's classc, "Constitutions" which those who read Pol. Science to at least the 2nd year would be familiar with.

I am impressed with the analysis.I have been wondering on what basis could Justice Anim Yeboah and others annul votes on the basis that a presiding officer did not sign a pink sheet just because a word is imperative and therefore must be given effect.What effect and what weight do you give to a constitutional duty and a constitutional right.The right to vote and a duty to sign a pink sheet.
I have no doubt that some of these questions will keep exercising the minds of Ghanaian jurists, lawyers and constitutional experts for a long time.Did the constitution require these judges to take such drastic measures in the face of an article which was silent on what happens as a repercussion for its breach.What flowed from that breach and the decision to annul was entirely that of the judges.Were they right to have gone that far to annul thousands of votes just because a presiding officer probably forgot to sign a pink sheet, I doubt that very much.
I hope with time when the politics had been taken out of our judicial reasoning we shall look to this judgement as a missed opportunity for showcasing our judicial maturity.

I am surprised that the NPP who pride themselves as legal brains missed this point and rushed to Court on impulse.
The word 'shall' is not the same as 'will'. Will is an imperative, shall is not. The NPP should have learnt a lesson from Al Gore, or should have taken counsel from him that to go to court in election disputes, is non winnable.
Akuffo Addo made a speech to the effect that in any election it is the voter that matters. Why is he changing his mind.Do Ghanaian voters not matter?

Noting that the word shall equally applied to the representatives of the candidates. Therefore if failure to sign by PO invalidates the votes, then equally failure to sign by Polling Agents must nullify the votes.
Then think of what will happen at a future election when NDC instructs all its agents not to sign pink sheets in Ashanti Region and also NPP ask all its Agents in the Volta Region not to sign pink sheets.
Can you deduce the absurdity involved in this blind interpretation of the word "Shall"

CI.75 was empowered by by the Constitution of Ghana, which required that votes be signed by Presiding Officers to make them valid. Most of the "vodoo mathematics" alias, "clerical/transpostional errors", were found on the unsigned sheets.
Those Presiding Officers who did not sign their pink sheets knew exactly what they were doing. Perhaps if the SC had stuck to its own questions in the end, most of the contorted Constitutional arguments would not have been necessary!
