Do you really believe critical and knowledgeable readers will be swayed by the "authority" you present here rather than your argument itself?
2. This is the third time I have read you in a piece on ghanaweb telling us that the NPP General Secretary, “Sir John,” was your room mate at Sarbah. Andy, why do you find it always always necessary to insist on telling us that? Why? Do you really believe that that fact is germane to the argument you are making? Or that your argument will be less persuasive if you didn't tell us that the said gentleman was your roommate?
You are always making self-referents as part of the argument you make but often the arguments can be made to stand on their own without any links to you - your personal self! I can understand it if it is a history in which you were involved and your actions changed the course of things. Often, this is not the case!
Then I read the rest of your argument and saw that it could have stood solidly on its own even if you hadn't informed us of your involvement with the law despite your not being a lawyer, or that Sir John was your Mensah Sarbah roommate (for the umpteenth time) or even that your sister worked at the AG's office.
In fact, I think your argument here would even have been more convincing to me if you had left out all the personal elements out of it!!!

Take my former roommate, Sir John for instance, (I'd drink beer with him anytime I am in Ghana), I mentioned him in establishing the call for his Paul to recuse himself from hearing the case. I must give sufficient information to buttress the claim I made.
References to my Sis was inserted for the readership who knew about my Sis.
I am perfectly aware that arguments can stand on their own without all those types of digressing points but real life is not based on logical postulates. That's why I said that even a good lawyer must learn to indulge in the fallacy of appeal to pity in court in order to sway the jury or judge to give a softer sentence! Many have been released on those appeals to pity!

Even an article written without any self-referents is still very much about yourself. There is no need to stress the fact, especially when the personal fact does not contribute to the argument itself. Maybe, some time, you may surreptitiously advertise yourself in a fleeting moment. But to hammer it home all the time the way you're doing is a different matter.
We all have classmates and we all were close to certain events in our country's history. But the discussion here is really not about us. It is about our country and, eventually, about truth which has not much to do with our personal selves. The truth must stand despite ourselves and our personal relationship to it. If you continue stressing the personal too much, it becomes a drawback to the enjoyment of your articles.
That is why some of us use monikers here. It's not about us. It's about truth and our country! Others may use monikers to insult others. But some of us use it only to express our heartfelt criticisms - irrespective of who we are!
But it's a free world - the greatest strength of the internet. You can continue the way you want and some of us will also continue to dislike that approach.

Since I don't use monikers, I am free to mention those who know me who can vouch for the veracity of what I say, or who are part of what I am writing about and therefore have a bearing on it, without fear or favour. Of course, if I want to insult someone, I do so without the need for a moniker. I am not afraid of defending what I write in cyberspace one day at Makola, Tantri and Kejetia Lorry Parks, for instance.
I make full disclosures of my relationships which could've affected my reasoning objectively BUT DON'T! What's wrong with that? I don't defend friends, relations, acquaintances, etc., here if I know that they are in the wrong. I may defend the same person in a post and lambast him in another. I don't owe anybody my views and don't write to conform to their wishes, likes and dislikes. Thanks, Hamid, for expressing your views too.

However, instead of them (NPP) to correct their mistake they have this to say: We the NPP leadership hope that, the President will cooperate with the proceedings of the court and help deepen the democratic credentials of the country. Now, the NPP already knows the president enjoys absolute immunity from legal proceedings but, according to their statement they HOPE the President will cooperate to deepen the democratic credentials of Ghana. I want you to underline the word HOPE.. Now, hoping for something that is not in our Constitution is infringement. What I want you to understand is that, if President Mahama honor the NPP's suit and proceed to court, that is violation of the "CONSTITUTION" which is the Supreme Law of the Land and he can be impeached for violating our Constitution. Andy, I got the impression from the earlier section of the article that there is vacuum of leadership in Ghana just before the President Elect is sworn in by the Chief Justice. That is not the case at all because until the President Elect is sworn in the outgoing President remains President to the very minute or second that the President Elect takes the oath of office. For example, on January 7, 2009 whilst Ghanaians were assembled at the Independence Square for the investiture of the late President Mills, President Kuffuor remained President until Mills had taken the oath of office. Unlike here in the UK where there a brief vacuum between the time the outgoing Prime Minister tenders his/her resignation to the Queen and when the Queen invites the incoming Prime Minister to form a government and actually goes to see the Queen to receive her blessing.
I have also shied away from writing on the legal issues pertaining to NPP's petition before the Supreme Court since I am not a lawyer. Now that you have opened the flood gates for pocket or armed -chair lawyers to contribute, I will also attempt to air my opinion sooner than later. Let's keep the debate going.

I watched the recent Mexican handing over and something like that occurred. That's what I refer to as a brief period of political interregnum.
In the case of the UK, since the Queen effetively is Head of State and the Prime Minister, as the farce goes, derives his/her powers from her even though the PM's office writes some of her major addresses to the nation, etc, (that explains why John Major could replace Thatcher and Gordon Brown Tony Blair withot winning elections), we can argue that a political interregnum does not occur when the PM goes to hand over powers to run the govt to the Queen.
Yes, by all means, weigh in on this debate.

The law that governed this election, CI74 states explicitly that the person whose election is been questioned is the first respondent. Mahama went into the eledtion as a citizen not as a president, that is why on the ballot we did not see his title: "Excellency" At that time he was an ordinary citizen despiite the fact that he is the incumbent president. In any case, even been the president does not grant him any immunity if he misconduct himself whilles in office. The law said that no verification no vote, why did Mahama made that distress call to the EC to allow people to vote even without the verification machine? All these are legitimate issues that need to be investigated. What did he go to do at the STL office in Dwowolo the nightof the elections, was it to see that all was going as planned? All these are on tape and will be released in court. We trust the Supreme Court because the are neither NPP nor NDC Court but Court of Ghana. Why should polling stations have votes cast more than registered voters and the results are still accepted, skewed in favour of Mahama? Why were party agents forced to sign documents for the return of the elections before counting was even done? Indeed, there are interesting times ahead of us in Ghana.

John Mahama is not being sued as 'president'. Rather, John Maham is being sued as a private citizen who ran for election as president. That he was president at the time or is president now, is irrelevant pursuant to the constitutional requirement for bringing such lawsuits!!

Actually, in the US (Washington, D.C. to be exact) in 1997, a Georgian diplomat, Gueorgui Makharadze,second to the ambassador in seniority was sentenced to 7-21 years prison term for manslaughter in the death of a 16 year old girl in a drunk driving case. He was released after 3 years to serve the remainder in Georgia! He had had a few drunk driving citations prior. When a case is so dastardly, immunity be damned!
Mahama's 'immunity' does not run roughshod over the essential requirement of peace and stability of the country, even as president.
Holding a citizen who is a president to account, is far better than the chaos that could ensue if a man were cloaked in the fancy garbs of presidential immunity. And taking him to court is a better choice than say in India where yesterday a senior politician who had raped a woman, was beaten up by a crowd of women. Pleas of immunity was taken, but contemptuously denied by the women!!

Yes, I've also read of countries asking fot diplomatic immunity to be removed in some grievous cases of diplomats committing some heinous crimes. The poor Georgian sod of a diplomat, no doubt, was sacrificed to please Uncle Sam.

To sue him is just a frivolous action caused by the uninformed and inexperienced democratic institutions framers in charge of Ghana presently who inserted a contradictory clause, forgetting that the President-elect can be the sitting President!

I have consistently made the case that Article 57(5) of the 1992 constitution gives the President ABSOLUTE immunity from any civil or criminal proceedings in any Court.
I have equally advanced the position by Ndebugre that the CI 78 which Nana and his colleagues based their decision to join President Mahama to the petition to the Supreme Court, is inferior to the Act of Parliament. And that where the Constitution says the person (President) cannot be sued while in office and a subsidiary legislation says somebody who happens to be a candidate and who is being complained against, you cannot use that to supersede the provision of the constitution which is the fundamental law of the land.
I had challenge two ill-informed so called court room lawyers who rubbished Paul Kuruk article and invited him for come court lessons. I made it clear that the Paul does not need any court room experience, not from them or any attorney, and that he is an authority in his own right.
I told those ignorant lawyers that they needed quality legal education to know that there are those who are constitutional experts who are or should not necessarily be lawyers or attorneys.

Well, I surely do know my K.C. Wheare, "Constitutions", very well, and so can't be bamboozled by any lawyer about matters const'nal. So in interpreting the Const. and legislation, where doubt or ambiguity exists, it is necessary to go behind the scene to get the intent of the framers by reading the attached Notes, White/Blue Papers, explaining the purpose of the particular clauses, etc. That should weigh in interpretating the clause, as I discovered when taking on the Foreign Office in Norway.
But in this case, as it is becoming clearer to me, it is not even an ambiguity in the Constitution, but conflict with a legislatve act or instrument, a fact I did not even deal with in my piece, as I couldn't believe that any lawyer worth his salt will expect a simple legislative instrument to take precedence over a const'nal clause! I was under the impression the NPP had discovered something from the Const, to bring the President into the suit! If it is indeed only under CI 78, which demarcated the 45 new constituencies with the NPP boycotting, etc, then, my goodness, what the heck are they arguing for or about?! It is a cold case that the Const'nal provision is superior! This is what we arm-chair lawyers call a "foolish case"!
And as an organisation theorist, if we are serious at all about building strong and respected democratic institutions, then it is up to the SC justices to quickly jettison the President from this case! It is a farce anyway. And if the President's lawyers open up a defence, I'd be back to hit out at them for continuing the lawlessness I had already pettitiond the President to put a stop to in the country!

This was in line with Article 125(1) of the constitution which directs that justice must be administered in the name of the Republic.
Rather, it was the notice summoning Tsatsu Tsikata to court which had the President's name on it.
